An interesting "exception" to COPPA compliance known as safe harbors. [16 CFR § 312.10] These are industry self regulation programs that are submitted to the FTC for approval. If approved, then those members who are certified as complying with that program are deemed to be in compliance with COPPA. The entity seeking FTC approval of their self regulation program will have to provide assurances to the FTC that the integrity of the program will be maintained. So far, three Safe Harbor programs have been approved: CARU, Truste, and ESRB Privacy Online. See FTC Safe Harbor Program Website.

| "The FTC is seeking public comment on an application for safe harbor treatment under the Rule from the Children's Advertising Review Unit ("CARU") of the Better Business Bureau. The COPPA includes a "safe harbor" provision designed to encourage increased industry self-regulation in this area. Under this provision, industry groups and others may request Commission approval of self-regulatory guidelines that would govern participants' compliance with the Rule. CARU is the second organization to file for approval under the safe harbor provisions. The public comment period will last for 30 days." |
